This workmen's compensation case represents a claim on behalf of Albert Simonton, an incompetent, by next friend, against his employer, Atlanta Laundries, Inc. The undisputed evidence shows that the claimant suffered a heat stroke on June 27, 1952, on which day he was employed by the defendant as a ""tripper"", his duties being to carry packages weighing between 9 and 24 pounds from the steam room to the loading platform and there load them; that on that day it was unusually hot, the temperature on the loading platform being 101 or 102 degrees in the shade, and that in the steam room being considerably higher; that his employer, on leaving the premises at about 11 a.m., was told by the claimant that he was feeling bad and the employer advised him not to work any more; that he would send him back home when he returned; that he returned around 3:30 p.m., and the employee had then been taken to the hospital. It appeared from medical testimony that the heat stroke affected the claimant's brain and speech centers, and that he was still hospitalized. An award was entered by the single hearing director in favor of the claimant, which award was, on appeal, affirmed by the full board and the Judge of the Superior Court of Fulton County respectively. The exception here is to the latter judgment of affirmance.
